Social Welfare Council Affiliation

Under Section 13 of the Social Welfare Act, 2049, the Social Welfare Council (SWC) serves as the apex regulatory body for the non-profit sector in Nepal. While registration at the DAO provides legal personality, SWC affiliation provides the “Operational Mandate.” It is a statutory requirement for any organization intended to receive technical or financial support from international donors or to implement social development programs in coordination with the Government of Nepal. 

Legal Requirements

Pursuant to the Social Welfare Act, 2049, the following prerequisites must be submitted to the Council: 

  • Primary Registration Documents: A certified copy of the NGO’s registration from the District Administration Office (DAO) or Office of the Company Registrar (OCR). 
  • Constitutional Compliance: Two copies of the organization’s Constitution (Bidhan), which must clearly state its social welfare objectives. 
  • Governance Records: Notarized citizenship copies and passport-size photographs of at least seven founding members, accompanied by recent Police Clearance Reports. 
  • Financial Transparency: A copy of the PAN Certificate and a commitment to submit annual audit reports to the Council. 

Consequences of Failure: 

  • Funding Deadlock: Without SWC affiliation, an NGO cannot legally sign a General Agreement (GA) or Project Agreement (PA) with international donors, effectively blocking foreign grant transfers. 
  • Banking Restrictions: Banks are prohibited from activating foreign currency accounts for NGOs that do not possess a valid SWC affiliation number. 
  • Loss of Exemptions: Non-affiliated entities are ineligible for VAT and Customs duty exemptions on equipment and materials imported for humanitarian or social purposes.
