VAT Deregistration is the formal statutory method required to terminate an active indirect tax identity for businesses closing operations, changing ownership structures, or falling consistently below mandatory registration thresholds.
Regulated by the Inland Revenue Department (IRD), a taxpayer cannot simply abandon an open VAT profile. The procedure is strictly governed by the state and mandates a specific sequence: lodging an online application via the IRD portal, calculating tax obligations on residual commercial inventory, settling past financial balances, and presenting physical ledger records for a definitive administrative audit. The registration remains legally binding until the tax officer reviews the closing files and formally strikes the entity from the national VAT register.
VAT profile cancellation is governed by Section 11 of the Value Added Tax Act, 2052 and Rule 12 of the Value Added Tax Rules, 2053. A cancellation can be requested by the taxpayer (or their legal heir if deceased) within 30 days of the closing condition arising, by submitting an application (Schedule-11) along with outstanding tax returns and payments. Even after applying for cancellation, the taxpayer must continue to file tax returns until they receive official confirmation of the cancellation, or for a maximum of 3 months. The concerned Tax Officer is legally obligated to notify the applicant whether their registration has been successfully cancelled or not within 3 months of receiving the application.
