Under Section 4 of the Contribution-based Social Security Act, 2074, every registered employer is legally bound to deposit monthly contributions to the Fund. Timely compliance is not just a tax obligation; it is the trigger that activates an employee’s access to medical, maternity, and accident insurance coverage.
Pursuant to Section 4 of the Contribution-based Social Security Act, 2074, and Social Security Scheme Operation Procedure, 2075, the monthly contribution to the SSF is set at 31% of the basic salary of the employee. All funds must be deposited within 15 days from the end of the Nepalese month in which the remuneration was earned.
Under Section 9, delayed deposits attract an interest rate of 10% per annum on the outstanding amount and may also give rise to unlimited Employer Liability if an accident occurs while the company is in default, the employer may be held personally liable to pay the full benefit amount (e.g., medical costs or life-long disability pension) that the SSF would have otherwise covered. The SSF authority has the power to withhold the renewal of business licenses, freeze bank accounts, and even restrict the passports of directors for persistent non-compliance.
